Zoning Board of Appeals
The Zoning Board of Appeals (ZBA) has appellate jurisdiction to hear and decide appeals from decisions of town officials responsible for administering and enforcing the zoning code (building department and planning department staff). In doing so the ZBA interprets the zoning code and grants variances. In granting any area or use variance the ZBA board members must apply statutory standards found in §267-b of the New York State Town Law. Glenville ZBA also has original jurisdiction to issue conditional use permits, by applying standards listed in §270-121 of the Town Zoning Code.
Application can be made by project applicants that have been denied a building permit or certificate of occupany by the Building Department; or planning/zoning applicants whose proposals do not meet the town's zoning code requirements. Applications must be submitted no later than 3 weeks prior to the scheduled meeting date. Contact the Building Department for denied building permits at (518)688-1200 X8 and the Economic Development & Planning Department for larger developments at (518)688-1200 X7.
